Terms and Conditions

Welcome to Nurture, the Learning Management System ("LMS" or the "Platform") developed and operated by S2S Education ("S2S Education", "we", "us", "our"). These Terms and Conditions ("Terms") constitute a legally binding agreement between S2S Education and you ("User", "you", "your") governing your access to and use of the Platform at nurture.s2seducation.com.

By logging in, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Notice. If you do not agree to these Terms, you must immediately cease using the Platform.

1. Platform Access and Account Security

• Eligibility: To use the Platform, you must be registered through an authorized educational institution, school, or organization that has a valid contract with S2S Education.
• Account Credentials: You are responsible for maintaining the confidentiality of your username, password, and single sign-on credentials. You agree to notify us immediately of any unauthorized access to or suspicious activity on your account.
• Role-Based Access: You are granted access to specific areas of the platform based on your assigned role (Student, Facilitator, or Administrator). Attempting to bypass access controls, gain unauthorized privileges, or manipulate session roles is a material violation of these Terms.

2. Acceptable Use and Code of Conduct

You agree to use the Platform only for lawful educational purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Platform.

You explicitly agree not to:

• Use the Platform to upload, distribute, or publish any material that is defamatory, offensive, abusive, hateful, or otherwise unlawful.
• Upload files containing viruses, Trojans, worms, time-bombs, or any software designed to disrupt, damage, or limit the functionality of the Platform or third-party devices.
• Engage in scraping, data mining, harvesting, or any automated extraction of course materials, student records, or user data.
• Attempt to probe, scan, test, or bypass the vulnerability of the Platform's network, security layers, or authentication mechanisms.
• Reverse engineer, decompile, or disassemble any part of the Platform’s code, assets, or software.
• Share your account credentials with any third party or permit others to access the Platform under your name.

3. Intellectual Property Rights

• S2S Education Ownership: All curriculum materials, interactive assets, text, designs, course layouts, graphics, software, source code, and logo designs on the Platform (collectively, "Content") are the sole property of S2S Education or its licensors and are protected by copyright, trademark, and intellectual property laws.
• Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access, view, and interact with the Content solely for individual educational and non-commercial purposes within the scope of your role.
• Restrictions: You may not copy, reproduce, republish, distribute, download, broadcast, sell, or exploit any Content from the Platform for commercial purposes or outside of the Platform interface without express prior written consent from S2S Education.
• User Submissions: By submitting work, comments, or assignments through the Platform (e.g., in quizzes, challenges, or bulletin boards), you grant S2S Education a non-exclusive, royalty-free, worldwide license to host, display, and process your submissions for educational and evaluation purposes.

4. Platform Availability and Disclaimer of Warranties

• Availability: We strive to keep the Nurture LMS accessible 24/7. However, access may be temporarily suspended, restricted, or interrupted due to scheduled maintenance, system updates, or emergency repairs.
• Disclaimer: The Platform and all its Content are provided on an "as is" and "as available" basis. S2S Education makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of the educational materials, nor do we guarantee that the Platform will operate uninterrupted, error-free, or free of security vulnerabilities.

5. Limitation of Liability

To the maximum extent permitted by applicable law, S2S Education, its affiliates, directors, officers, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of academic progress, loss of revenue, or service interruptions, arising out of or related to your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

6. Indemnification

You agree to indemnify, defend, and hold harmless S2S Education, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Platform, or your violation of any third-party rights or applicable laws.

7. Termination of Use

• Suspension/Termination by Us: S2S Education reserves the right, in its sole discretion, to suspend or terminate your access to the Platform at any time, without prior notice, if we believe you have violated these Terms, engaged in security-compromising activities, or if your sponsoring educational institution terminates its agreement with us.
• Effect of Termination: Upon termination, your right to access the Platform and its Content will immediately cease. Any account information or progress logs may be deactivated or deleted in accordance with our data retention policy.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which S2S Education is registered, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts of that jurisdiction.

9. Changes to These Terms

S2S Education reserves the right to amend or update these Terms at any time. The most current version will always be posted on the Platform, with the "Last updated" date adjusted accordingly. Your continued use of the Platform after changes have been posted constitutes your acceptance of the revised Terms.
